Terms and Conditions
These terms apply to work we carry out for you as a customer. They sit alongside the written quote we give you for your job. If anything in your quote is different from these terms, the quote takes priority. EZ Roof (“we”, “us”) is a roofing and solar installation contractor serving Cheshire.
1. Quotes and estimates
- Quotes are free and are given in writing after we have inspected the property or been given enough information to price the work.
- A quote is valid for 30 days unless it says otherwise. Prices may change after that, or if the work described changes.
- A quote covers only the work listed in it. Extra work, such as repairing rotten timbers or defective structure found once the roof is open, is quoted and agreed with you before we carry it out.
2. Booking and deposits
A job is booked when you accept our written quote. For larger jobs we may ask for a deposit before ordering materials or starting work. Any deposit, and the schedule for further payments, is stated in the quote. Deposits go towards the agreed price.
3. Your right to cancel
If you accepted a quote away from our premises, for example at your home, or by phone or email, you normally have 14 days from the day you accept it to cancel without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To cancel, tell us clearly in writing, for example by email using the details on our contact page.
If you ask us to start work within the 14-day period, we will ask you to confirm that in writing. If you then cancel, you must pay for the work done up to the point you told us you were cancelling, and for any materials already ordered that cannot be returned. If the work is finished within the 14 days and you asked us to start within that time, you lose the right to cancel once it is fully completed.
4. Payment
- Payment is due as set out in the quote. Unless it says otherwise, the balance is due on completion.
- We accept bank transfer and, where agreed, card payments. We will give you a receipt or invoice.
- If an invoice is not paid on time, we may charge interest at the rate allowed by the Late Payment of Commercial Debts (Interest) Act 1998 for business customers, and we may suspend further work until it is paid.
- Materials supplied remain ours until they have been paid for in full.
5. Access, permissions and services
- You agree to give us safe access to the property and the work area, with water and power where we need them.
- You are responsible for any planning permission, listed building or conservation area consent, landlord or freeholder consent and Building Regulations approval the work needs, unless our quote says we will apply for it. We can advise on what is likely to apply, and for solar we handle the notification to your network operator.
- Please tell us before we start about buried cables, pipes, drains, tanks and anything else that might be under or near the work area. We will take reasonable care, but we cannot be responsible for services that are not marked or that we were not told about.
- We will tell you if we find something unexpected, such as poor ground, hidden damage or contamination, that changes the work or the price.
6. Changes to the work
If you ask us to change the work after you have accepted the quote, or if the work needs to change because of conditions we could not see beforehand, we will explain the change and its cost before we carry it out. Changes are agreed in writing, including by email or message.
7. Timing and weather
We will give you start and finish dates in good faith, but work done outside is affected by weather and conditions. Roofing and solar work is done at height and outdoors, so wind, rain, ice and snow can stop work for safety or quality reasons, and flat roof systems such as GRP need dry conditions. We will tell you as early as we can if the dates change, and we are not responsible for delays outside our reasonable control.
8. Materials
Natural materials such as slate, clay tile and lead vary in colour, shade and texture, and new materials can look different from samples, photographs or the existing roof until they weather. Where we cannot get an exact match for existing materials we will tell you and agree the closest match with you. Solar equipment is supplied to the specification in the quote, and a manufacturer may substitute an equivalent model if the specified one is unavailable, which we will tell you about and agree with you first.
9. Quality and guarantees
We carry out our work with reasonable skill and care and in line with the quote. Under the Consumer Rights Act 2015, services must be performed with reasonable care and skill, and if they are not, you are entitled to ask us to put it right or to a price reduction. Any guarantee we give for particular work is stated in the quote. Guarantees do not cover damage caused by misuse, neglect, lack of maintenance, other contractors, movement of the ground or building, or events such as storms and flooding.
10. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Otherwise, our liability to you is limited to the cost of putting right the work, and we are not liable for indirect or consequential loss.
11. Complaints
If you are not happy with any part of the work, please tell us straight away by phone or email using the details on our contact page, with details and photographs if you can. We will acknowledge your complaint promptly, look into it and tell you how we propose to put things right. If we cannot agree, you may use an alternative dispute resolution service, and you keep your legal rights.
12. Your information
We use your personal information as set out in our privacy policy, and cookies as set out in our cookie policy.
13. General
These terms, and any dispute connected with them, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, although if you live in Scotland or Northern Ireland you may bring proceedings in your home courts. If any part of these terms is found unenforceable, the rest remains in force. We may update these terms from time to time; the version in force when you accepted your quote applies to your job.
